The purpose of these Terms of Use (TOU) is to set out all of the Site access and use conditions.

Access to and use of the Site entail the User’s tacit and unreserved acceptance of these TOU in their latest on-line version.

Access to the Site is open to any person wishing to learn about the company TRACES TPi.

The Site is accessible continually and permanently, save cases of force majeure or events beyond the company’s control, and with the reservation of possible breakdowns and maintenance operations needed to keep the Site working properly.  What is more, due to the very nature of the Internet, TRACES TPi cannot guarantee that the Site will work round the clock, 24/7.

TRACES TPi strives to give Users the most reliable and best quality information possible.  TRACES TPi cannot, however, guarantee the accuracy and exhaustiveness of the information disseminated on the Site.  Consequently, TRACES TPi may not be held liable for any direct or indirect damages sustained by users or third parties as a result of information disseminated on the Site and, more generally, as a result of consulting and using the Site.

TRACES TPi has no control over the sites that are linked to the Site by hypertext links and shall not be held responsible for anything related to these sites and their contents.

All the data of whatever kind, and especially texts, graphics, logos, icons, pictures, audio and video clips, trademarks, and software, on the Site are necessarily protected by copyright, droits d’auteur, trademark law, and all other intellectual property rights.

TRACES TPi, as Publisher of the Site, grants the User a private, non-collective, and non-exclusive right to use the said content.

In accepting these TOU, the User agrees not to reproduce, summarise, modify, distort, or redisseminate any text, title, application, software, logo, trademark, information, or illustration for any use other than her/his strictly personal and non-commercial use, which excludes all representation for professional purposes or for redistribution in large numbers, without the Publisher’s specific prior consent.  The User also agrees not to recopy all or part of the Site onto another site or a company intranet.

All of the available data and contents published on the Site, as well as the procedures for consulting them, form the Database of TRACES TPi’s Internet Site.  This Database is protected by the provisions of the French Intellectual Property Code concerning copyright and droits d’auteur as well as by the provisions of Directive 96/9/EC of the European Parliament and of the Council of 11 March 1996 on the legal protection of databases.

Under these conditions, the User agrees to use these data within the strict confines of consulting the Internet Site and shall not reproduce, translate, adapt, arrange, transform, communicate, represent, or distribute, whether permanently or temporarily, all or part of the data contained in these databases, by any means and in any form.

The creation of any hypertext link from an Internet site to the Site requires TRACES TPi’s specific consent.

Pursuant to the French data privacy act (No 78-17) of 6 January 1978, Users who ask to subscribe to the proposed services have access to and a right to change and remove the data that concern them.  To exercise this right, they need only post a letter to TRACES TPi at the following address:  17 rue du Cayaux, B-5620 FLAVION, Belgium.

Personal information about Users that is collected by means of forms and all future information are intended for TRACES TPi’s exclusive use in implementing the services that it provides its Users.  This information shall not be communicated or transferred to third parties.

TRACES TPi keeps its Users’ personal data on its own servers and shall keep the personal data that it collects strictly confidential.

Should one of the provisions in these Terms of Use be considered null and void by virtue of a current or future legal or regulatory measure or a legal decision having the force of res judicata and issued by a court of law or a body with jurisdiction over the matter, this provision in the contract shall be considered unwritten; all the other provisions in these Terms of Use shall continue to be binding between the Parties.

TRACES TPi reserves the right to change the terms of these TOU unilaterally.  The new clauses will govern all relations between the parties in the future and only the new version will be valid.

If a dispute should arise, the parties agree to attempt to reach an out-of-court settlement before referring the matter to the competent court.
